Introduction

Bench IQ gives attorneys a window into how their judges think. We use large language models to analyze judges’ rulings to uncover the reasons behind their decisions. 

We understand that you are aware of and care about your own personal privacy interests, and we take that seriously. This Privacy Notice describes Bench IQ’s policies and practices regarding its collection and use of your personal data, and sets forth your privacy rights. We recognize that information privacy is an ongoing responsibility, and so we will from time to time update this Privacy Notice as we undertake new personal data practices or adopt new privacy policies.

This Privacy Policy applies to the Bench IQ website (www.benchiq.com), associated services, and any interactions you may have with us in the course of using our services.

We reserve the right to update this Privacy Policy at any time. If we make material changes, we will notify you by email or by posting a notice on our website prior to the effective date of the changes.

How we use (process) your personal information

Bench IQ stores and processes personal information about users of the Bench IQ application, and collects information about visitors to www.benchiq.com. With a few exceptions, this information is generally limited to:

  • name 

  • job title 

  • employer name 

  • work email 

  • work phone number 

We use this information to provide users with the services we offer. Because our users are lawyers or employees of law firms, this personal information is publicly available at the firm’s website. In addition, this personal information is publicly available, inter alia, at websites operated by state lawyer and court regulatory bodies, such as the Illinois Attorney Registration and Disciplinary Commission and the New York Unified Court System; and this personal information for attorneys representing parties to US federal litigation is publicly available at the PACER website maintained by the Administrative Office of U.S. Courts. As such, you should have no expectation of privacy in the use of this information.

We do not sell or rent personal information to anyone. We utilize third party service providers who facilitate the delivery of our services. These service providers may store or process personal information but operate under a duty of confidentiality.

We also may use personal information as we believe necessary or appropriate to comply with applicable laws, lawful requests, and legal process, and to pursue remedies available to us and limiting our damages such as from unauthorized access to our services and other illegal activities. 

Use of www.benchiq.com

As is true of most other websites, www.benchiq.com collects certain information automatically and stores it in log files. The information may include internet protocol (IP) addresses, the region or general location where your computer or device is accessing the internet, browser type, operating system and other usage information about the use of www.benchiq.com, including a history of the pages you view. We use this information to help us design our site to better suit our users’ needs. We may also use your IP address to help diagnose problems with our server and to administer our website, analyze trends, track visitor movements, and gather broad demographic information that assists us in identifying visitor preferences.

Bench IQ has a legitimate interest in understanding how customers and potential customers use www.benchiq.com. This assists Bench IQ with providing more relevant products and services, with communicating value to our investors, and with providing appropriate staffing to meet customer needs.

For the Bench IQ application, found athttps://app.benchiq.com, we only use essential cookies to provide a secure and authenticated experience, facilitate log-in, and customize the user experience. Sharing information with third parties

The personal information Bench IQ collects from you is stored in one or more databases hosted by third parties located in the United States. These third parties do not use or have access to your personal information for any purpose other than cloud storage and retrieval, and facilitating the services we provide. 

These third parties are currently: Typeform, Mixpanel, Intercom, FullStory, Segment, Amazon Web Services, Heroku, Notion, Hubspot, Postmark, Slack, Sentry, and Datadog.

We do not otherwise reveal your personal data to non-Bench IQ persons or businesses for their independent use unless: (1) you request or authorize it; (2) the information is provided to comply with the law (for example, compelled by law enforcement to comply with a search warrant, subpoena, or court order), enforce an agreement we have with you, or to protect our rights, property or safety, or the rights, property or safety of our employees or others; (3) it is necessary to address disputes, claims, or to persons demonstrating legal authority to act on your behalf. Our promise above to not reveal information does not apply in the case of a theft of information due to data hacking or a breach of cybersecurity incident, which revelation would by definition be unintended by us.

Personal data to the U.S.

Bench IQ has its headquarters in the United States. Information we collect about you will be stored and processed in the United States. By using Bench IQ’s services, you acknowledge that your personal information will be processed in the United States. 

Bench IQ endeavors to apply suitable safeguards to protect the privacy and security of your personal data and to use it only consistent with your relationship with Bench IQ and the practices described in this Privacy Policy. Bench IQ also enters into data processing agreements and model clauses with its vendors whenever feasible and appropriate. Since it was founded, Bench IQ has received zero government requests for information.

Your rights

This Privacy Notice is intended to provide you with information about what personal data Bench IQ collects about you and how it is used. 

If you wish to confirm that Bench IQ is processing your personal data, or to have access to the personal data Bench IQ may have about you, please contact us at [email protected].

You may also request information about: the purpose of the processing; the categories of personal data we store and process; who else outside Bench IQ might have received the data from Bench IQ; and how long it will be stored. You have a right to correct (rectify) the record of your personal data maintained by Bench IQ if it is inaccurate. You may request that Bench IQ erase that data or cease processing it; although in that case you would no longer be able to use or access the Bench IQ application. We may be required to retain it in certain circumstances, such as pending claims or litigation, or by governmental request. You may also unsubscribe from communications from Bench IQ, except for operational notices and emergency notifications. In many countries, you have a right to lodge a complaint with the appropriate data protection authority if you have concerns about how Bench IQ processes your personal data. When technically feasible, Bench IQ will—at your request—provide your personal data to you.

Reasonable access to your personal data will be provided at no cost. If access cannot be provided within a reasonable time frame, Bench IQ will provide you with a date when the information will be provided. If for some reason access is denied, Bench IQ will provide an explanation as to why access has been denied.

Data storage and retention

Your personal data is stored by the Bench IQ on its servers, and on the servers of the cloud-based database management services Bench IQ engages, located in the United States. Bench IQ retains service data for the duration of the customer’s business relationship with Bench IQ and for a period of time thereafter, to analyze the data for Bench IQ’s own operations, and for historical and archiving purposes associated with Bench IQ’s services.
